Fort Lauderdale Uber And Lyft Accident Lawyer

Accidents involving Uber and Lyft drivers can be confusing. In many cases, the compensation comes from the driver directly with the assistance of insurance policies from Uber and Lyft, but you usually cannot sue the rideshare companies for these kinds of accidents. Filing a lawsuit to get compensation for injuries can be intimidating, but if you have serious medical expenses, lost wages, and pain and suffering, a lawsuit might be the best way to seek justice and financial compensation.

For a free legal consultation on your accident case, call me, a Fort Lauderdale Uber and Lyft accident lawyer at my firm, Jared Newman, Esq. Filing A Lawsuit For Injuries After An Uber Or Lyft Accident In Fort Lauderdale

Car accidents can happen in various ways that affect people differently, and I am prepared to represent anyone who was involved in one of these crashes. I can figure out which parties are responsible and help you sue the right parties and file the right insurance claims to get the compensation you deserve after a crash.

Passengers

Riders in Ubers and Lyfts can often file insurance claims and lawsuits after a crash since someone else was likely at fault. Whether the accident was caused by the Uber or Lyft driver you were riding with or a driver in another car that hit you, you can file a claim against the responsible driver to get compensation. The same is true for passengers in another car involved in an accident with an Uber or Lyft driver. I will fight to hold the at-fault driver responsible.

Drivers

When an accident involves two or more cars, the drivers who caused the crash are held responsible. Whether you were the Uber or Lyft driver or the driver in the other car, I can fight for you if you were the victim of the crash. When car accidents involve an on-duty Uber or Lyft driver, there may be additional insurance to cover all injured parties in the crash, which I can fight to draw on to help cover your damages.

Pedestrians And Cyclists

If you were injured as a pedestrian or a cyclist hit by an Uber or Lyft driver, I can also fight for you. Accidents in which a person is hit by an Uber or Lyft vehicle can often cause serious injuries, and I can work to help you get compensation for medical bills and other expenses related to the crash.

Getting Compensation For Uber And Lyft Accidents In Florida

Under Florida’s car insurance rules, every driver is required to carry no-fault insurance that will cover them and the injured passengers in their car in the event of an accident. This means that, typically, you would file a claim with your own insurance after a crash. However, if you are injured as a passenger riding in an Uber or Lyft vehicle, then you should not need to draw from your own insurance, and you will instead be able to file a claim against Uber or Lyft’s insurance or another at-fault driver’s insurance to get the compensation you need. In many cases, serious injuries can also warrant a lawsuit that can help unlock additional damages.

Whose Insurance Pays For Damages?

When you are injured in an Uber or Lyft accident as a rider, the rideshare company’s million-dollar insurance policy should cover you in many cases. Both companies have high-dollar insurance policies that cover accidents involving their drivers as long as the accident occurs sometime between accepting a ride and dropping off the passenger. That means that anytime there is a passenger in the Uber/Lyft, the extra insurance should cover the crash. This can help not only riders, but also pedestrians or people in other cars injured in the crash.

If the accident occurred when the driver was on duty but before they accepted a ride, then another supplemental policy with a lower policy limit should supplement payments for the crash. Otherwise, the Uber or Lyft driver’s own car insurance covers the accident.

In many cases, you can sue instead of seeking an insurance payout. If there is an insurance policy in place to cover the accident, then the insurance company would still be the one paying damages; they would just do so under court order instead of paying what they think is fair after their adjuster analyzes the case. When you file a lawsuit instead of an insurance claim, the court can also order additional damages for pain and suffering and other “noneconomic” damages that the insurance policy might not cover.

When suing for an Uber or Lyft accident, you sue the responsible driver. Usually, when you sue a taxi driver or a bus driver or another commercial driver for accidents that happen while they are on the job, you can also sue their employer. Unfortunately, Uber and Lyft drivers are independent contractors, not employees, which usually shields Uber and Lyft from liability in these kinds of crashes. Still, I can fight to get you compensation from the right parties.
